These terms and conditions govern the sale of products to consumers through the web shop owned by Sculpto.

  1. Ordering and paying

Sculpto.eu is open 24 hours a day which means that it’s almost always possible to make orders in the web shop. Occasionally, the will be inaccessible due to maintenance. You’re only able to order products from the web shop when the web shop is open and accessible.

In order to legally being able to shop at sculpto.eu, you must have turned 18 years of age and in possession of a valid paying card that is also accepted by Sculpto.
If you’re not at least 18 years of age, you can place an order in our web shop with the acceptance of your legal guardian, or if you otherwise have the legal right to place the order.

 

  1. How to buy at sculpto.eu (consumers)

You choose the product(s) you want to buy and add them to the “shopping cart”. Up until the time of ordering you can make changes in the content of the shopping cart and you can continuously see a list of the content and the prices thereof.

Possible additional shipping or credit card fees will be added when you proceed to the checkout page.
When you are ready to place your order, simply click on the shopping cart and fill in your name, address (and the shipping address if that address isn’t the same as your personal address), e-mail, telephone number and payment method.
You are able to change the content of the shopping cart right up until the moment where you confirm your order by pushing “Confirm and pay”. At this point, your order will be sent to Sculpto.

 

Possible payment methods

We offer a variety of different payment methods. The most secure and the payment method we recommend all our customers is payment by a payment card. We accept the following payment methods:

Paying online by payment card

When paying using an electronic payment card, the amount will only be withdrawn when your order has been shipped. The transaction happens via a secure and encrypted SSL (Secure Socket Layer) connection. This means that the payment information given by you cannot be seen by a third party. When paying using a payment card, we reserve the right to verify the validity of the personal data provided by you. We can, at any time, decrease the total amount of your order - if e.g. a product is sold out or is no longer requested by the costumer - but for security reasons, we can NEVER increase the total amount.

 

  1. Order receipt and confirmation

When you place an order with us, you will receive an e-mail with an order receipt. However, in case of ordering an item no longer in stock or in case of incorrect information about the item, we reserve the right to cancel the order. Only when you receive a order confirmation from us, the order is legally binding.

 

  1. Shipping

Who delivers your order?
Your package will be sent with Post Danmark, GLS or DHL.

How much does it cost? 
By deliveries to addresses in Denmark, it's usually GLS or PostNord who handles the shipping. By deliveries outside of Denmark, it's usually GLS, PostNord or DHL.

How long does it take?
You can find the estimated duration of delivery on each product page. On the day of shipment, you will receive an e-mail with an invoice. Remember to check your spam/junk e-mail folder if you shouldn’t receive such an e-mail.

 

  1. Return    

Right of cancellation (14 days)

When buying online at sculpto.eu, your right of cancellation usually lasts 14 days. If you during this period of time should regret your buy, you can inform us hereof (not later than 14 days after delivery of the order) and hereafter ship the item(s) back to us.

The end date is the end of 14 days after the day on which you receive the product(s). If the end date is e.g. on a holiday, Saturday, Christmas Eve or New Year’s Eve, the end date will be postponed to the following workday.

In case of an order containing multiple items that are delivered separately, the end date is 14 days after the day on which you receive the last installment of the product or the last of the separate products ordered.

After reception of the ordered product(s), you may only handle the product(s) in a reasonable way that allows you to determine the nature and qualities of the product(s) and the way they function. Handling the product(s) in another way may harm your rights of cancellation.

In order to make use of your right of cancellation, you have to inform us hereof in a written explicit statement not later than 14 days after the delivery of the order to you.

 

If you wish to return one or more items:

In that case, you can ship the item(s) back to us using your local postal service. Be aware that you bear the shipping costs. You have to inform us in writing hereof to kontakt@sculpto.dk before you return your item(s).

If you choose to return an ordered item, you need to make sure that the item is securely packaged. You bear the responsibility of the condition of the item up until it being delivered to us. Therefore, always save your postal receipt and tracking number of the parcel.

IMPORTANT
We expect that you send the item(s) back to us as soon as possible and the item(s) has to be shipped not later than 14 days after having informed us of your decision to cancel your order.

Documentation of purchase

It’s important that you in the parcel enclose your documentation of purchase that you received when buying the item(s).

 

  1. Refund

When we receive the item(s) that you sent back to us, we will examine the item(s) and hereafter we will refund the amount that you originally payed for the item(s).

The amount will always be transferred to the same payment method that you used when ordering the item(s). If you for example payed per payment card, the amount will be refunded to this exact payment card.

NOTICE:
You could lose your right to a refund - partially or entirely. This could occur if the worth of the item(s) has been reduced due to

- it having been used,

- it having been damaged whilst being in your care,

- you having handled the item(s) in another than reasonable way that allows you to determine the nature and qualities of the product(s) and the way they function

- you not respecting the limitations of your right of cancellation in accordance with sealing, kind of goods etc.

 

  1. Complaint - If something is wrong with the product(s)

We provide a warranty that on delivery and for period of 24 months from delivery, the product(s) shall be free from material defects. This means that if the product(s) has one or more material defects, you can get the product(s) repaired, replaced, get your money back or a price reduction, depending on the given situation. However, this warranty does not apply in the circumstances of

(a) fair wear and tear;

(b) willful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;

(c) you failing to operate or use the Products in accordance with the user instructions;

(d) any alteration or repair by you or by a third party who is not one of our authorised repairers; or

(e) any specification provided by you.

You need to contact us within "reasonable time”

You need to make a complaint to us within ”reasonable time” after having discovered the defect of the product(s). We recommend that you send us your complain as soon as possible.

When returning the product(s), please add a detailed description of the problem. This is not a requirement, but it helps make the case handling more efficient and reduces the processing time of your complaint.

If your complaint turns out to be justified, we will refund any reasonable shipping costs you may have had.

If your complaint turns out to be unjustified, you bear all shipping costs, including the shipping costs we may have returning the product(s) to you after our examination.

Notice that you should always send the product(s) securely packaged and get a postal receipt. You bear the responsibility of the condition of the item until it being delivered to us.  Therefore, always save your postal receipt and tracking number of the parcel.

  1. Personal data

In order for you to place an order at sculpto.eu, you need to inform us of your:

Address
E-mail
Telephone number

This data will, in accordance with Danish law, be stored together with the information of the product(s) you’ve ordered for up to 5 years from the end of the given financial year. After this period of time the data will be deleted.

However, if you have created an account when ordering from us, your personal data will not be deleted, unless you ask us to.

The data will not be given or sold to a third party, unless this occurs in connection with a reorganization or a partial or complete sale of the company.
A possible transmission in such a scenario will happen in accordance with the Danish Act on Processing of Personal Data in force at the given time.

As a customer, you are able to gain insight into our registration of your personal data and you can object to such a registration in accordance with the legislation on the handling of personal data.   1. Cookies

By using sculpto.eu you accept our use of cookies. A cookie is a small text file that we put on your computer for tracking what happens during your visit to our website and recognizing the computer. A cookie is not a program and doesn’t contain viruses.

 

  1. Applicable law and venue

The buying of products on sculpto.eu is subject to Danish law. Any dispute will be decided in a Danish court of law.
